SwitchBot AI+ Service User Agreement

This Agreement is entered into by and between the provider and operator of SwitchBot products/services (hereinafter referred to as "SwitchBot" or "we," including SWITCHBOT Co., Ltd., Wonderlabs Inc., and their parent companies, subsidiaries, or affiliates) and all entities (including but not limited to individuals, teams, etc., hereinafter referred to as "Users") that use the AI+ services provided by SwitchBot, regarding the use of AI+ services and related services.
This Agreement applies to any AI+ services provided by SwitchBot (hereinafter referred to as "AI+ Services" or "Services"), including upgrades and updates to services and software used by Users during the term of this Agreement. By using any AI+ Service, you accept all terms of this Agreement.
SwitchBot fully respects the protection of users' personal information. Therefore, please read the AI+ Service Video Collection Privacy Policy to fully understand the policies and procedures governing the collection and use of your personal information under the AI+ functionality.
The specific terms used in this User Agreement are defined as follows: App: Applications provided by SwitchBot that can connect to SwitchBot products or services. SwitchBot AI Hub: A gateway product provided by SwitchBot. SwitchBot Camera: All camera series products provided by SwitchBot.
1.Service Content and Usage Notes
1.1 The AI+ Service is a subscription-based online service activated through the App, which provides users with event video storage, synchronization, management, and sharing. Once a user activates any service package, cameras bound to the AI Hub will begin collecting video footage. Locally deployed AI models in the camera detect human movement or scene changes; upon detecting such trigger events, the camera records the video and uploads part of the images in encrypted form to the cloud. Data usage is based on purchased traffic packages, and fees follow actual payments..Events generated within AI Hub will consume traffic. AI Hub outputs may be incomplete, inaccurate, or unsuitable due to data source limits, algorithm biases, or recognition errors. Users should evaluate accuracy/applicability independently and seek professional advice if needed. SwitchBot is not liable for any direct or indirect loss caused by reliance on such outputs.
1.2 Services may vary depending on the user’s country/region.
Free trial services, where applicable, begin upon the first activation of AI+ Services. No charges apply during the free trial. Users may cancel during the trial but can continue using the service until the end of the trial period. SwitchBot reserves the right to make the final interpretation of the free trial service.SwitchBot reserves the right to modify or cancel trial offers without prior notice, though ongoing trials will not be affected.
1.3 Upon trial expiration, subscriptions automatically renew, activating the service package selected by the user and charging the linked payment account accordingly. The service fee amount is determined by the specific subscription plan chosen by the user in the App. Monthly plans: 30-day cycle.If the user does not cancel the service package before the end of the service period, we will continue to activate the service for the next service period through automatic renewal on the day the service period expires and deduct the service fee for the next service period. Annual plans: 365-day cycle.If the user does not cancel the service package before the end of the service period, we will continue to activate the service for the next service period through automatic renewal on the day the service period expires and deduct the service fee for the next service period. Data is stored on a rolling 30-day basis; data older than 30 days will be overwritten.
1.4 Subscription payments are processed through app stores. Payment details are stored by third-party providers. Users must keep payment information accurate and up to date especially when changing different payment tools or payment tools have expired.. If payment tools expire or fail, and the user neither updates the payment method nor cancels the subscription,SwitchBot may cancel the subscription before the next billing date.
1.5 For auto-renew subscriptions, fees are charged on calendar date corresponding to the subscription date (free trial expiration date, if applicable) monthly/annually( depending on the billing cycle of the subscription). Users may switch plans at the end of the subscription cycle. Plan adjustments (content, pricing) may occur, but existing subscribers remain unaffected until renewal.
1.6 To avoid charges for the next billing cycle, cancellation must be made at least 3 calendar days before the next billing date. Cancellation on/after renewal takes effect at the next billing date; users remain responsible for the current cycle’s fee.
1.7 AI+ Services only provide network services. the costs of equipment related to the relevant network services (such as personal computers, mobile phones, and other devices related to Internet or mobile network access) and the associated expenses (such as telephone charges and Internet access fees for Internet access, and mobile phone charges for mobile network use) are the user’s responsibility.
1.8 You may link multiple devices (including AI Hub and cameras) to the same account. All AI+ services for these devices will be activated under this account, and you will not need to register or purchase additional accounts. If you actively disable AI+ services, all devices linked to your account will simultaneously stop AI+ services. When you re-enable AI+ services, the system will re-display this agreement and all privacy policies related to AI+ services for your review and confirmation.
1.9 When you first open any device using your account, we will display this agreement and all privacy policies related to AI+ services. Please read and confirm your agreement. Once you check the box to agree, this agreement applies to all existing and future devices linked to your account. When you open the device again or enable AI+ services on other devices linked to your account, we will assume that you have fully read and accepted the above agreement, and the system will no longer display the agreement again.
1.10 All data usage from devices bound to your account will be uniformly included in the service package you purchased for your account. Camera recording and filming will not consume additional data or incur extra charges.
2.Ownership
2.1 Users agree and acknowledge that SwitchBot or its licensors own all legal rights, title, and interest in and to the Service (including, but not limited to, the graphics, user interface, scripts, software, and text used to operate the Service) and any software provided to the user as part of or in connection with the Service (the “Software”), including all intellectual property rights therein, whether registered or unregistered, and regardless of their location worldwide. Users further agree that the Service (including the Software and any other components thereof) contains proprietary and confidential information protected by applicable intellectual property laws and other laws (including but not limited to copyright laws). Users agree not to use such proprietary information or materials in any manner, except as necessary to use the Service in accordance with this Agreement. Except as expressly permitted by the terms of this Agreement, no part of the Service may be reproduced in any form or by any means.
2.2 SwitchBot retains full and inalienable ownership and intellectual property rights to the following items (information, data, text, software, music, audio, photos, graphics, videos, user registration information, or other data, hereinafter referred to as “content”): except for content uploaded and disseminated by users themselves, AI+ services and all elements thereof, including but not limited to all content, data, technology, software, code, user interfaces, and any derivative works related thereto.
3.Commitments and Warranties
3.1 Users guarantee uploaded content will not:
Remove or conceal or alter any patent, copyright, trademark, or other proprietary notices displayed on or contained in the AI+ Service; Interfering or attempting to interfere with the normal operation of any part or function of AI+ services or the SwitchBot website or app in any wayy; Avoid, attempt to avoid, or claim to be able to avoid any content protection mechanisms or AI+ service data measurement tools; Misuse in written or graphic form SwitchBot any registered or unregistered trademarks,service marks, company logos, URLs or other marks originating without SwitchBot's prior written approval; Use any SwitchBot mark, including but not limited to using SwitchBot marks in a manner that tarnishes, weakens, or damages the rights of the owner of such marks, or granting any rights or permissions to yourself or others in violation of this Agreement, unless SwitchBot specifies in writing. Impersonate others to gain access. Violations may result in warnings, temporary or permanent blocking, or termination of access, at the sole discretion of SwitchBot. Users shall be solely liable for any damages caused to SwitchBot, other users, or any partners of SwitchBot as a result of such violations, and shall bear all legal responsibilities and compensate for all losses incurred.
3.2 Users further commit to:
Obtain written authorization from the rights holder (if any) of the content uploaded, published, transmitted, or disseminated through other means using AI+ services. Reach an internal agreement with the aforementioned rights holder on the distribution of rights and interests to ensure that they have sufficient, complete, unblemished, and exclusive ownership and intellectual property rights before submitting and uploading the relevant content to AI+ services; Avoid using AI+ services to upload, publish, transmit, or otherwise disseminate illegal or prohibited content; Not use services for unlawful purposes; Not use SwitchBot's AI+ service in any form to infringe upon SwitchBot's commercial interests, including but not limited to posting commercial advertisements without SwitchBot's permission; Not use the AI+ service system to engage in any activities that may adversely affect the normal operation of the internet or mobile networks; Not engage in harmful cyber the normal operation of AI+ services or any part or function of the SwitchBot website or app,including:(1) Accessing computer information networks or their resources without authorization; (2)Deleting, modifying, or adding to the functions of computer information networks without authorization; (3)Deleting, modifying, or adding to data or applications stored, processed, or transmitted within computer information networks without authorization; (4)Intentionally creating or spreading computer viruses or other destructive programs; (5)Other acts that endanger the security of computer information networks. ; If any content uploaded, posted, transmitted, or otherwise disseminated by the user through the AI+ service contains defects in rights or infringes upon the legitimate rights and interests of third parties (including but not limited to patent rights, trademark rights, copyrights and neighboring rights, portrait rights, privacy rights, reputation rights, etc.), resulting in SwitchBot or other entities collaborating with SwitchBot facing any complaints, reports, inquiries, claims, or lawsuits; or if SwitchBot or other entities collaborating with SwitchBot suffer any reputational, reputational, or property losses as a result, the user shall actively take all possible measures to ensure that SwitchBot and other entities collaborating with SwitchBot are not affected by such claims or lawsuits. At the same time, the user shall bear full liability for any direct or indirect economic losses suffered by SwitchBot and other entities collaborating with SwitchBot as a result; Users shall not abuse the AI+ service. SwitchBot hereby solemnly reminds users that any content uploaded, posted, sent via instant messages, emails, or any other means through this service, whether publicly or privately transmitted, shall be the sole responsibility of the content provider or user for their uploading or usage. As an information storage space service platform, the AI+ service cannot control the content transmitted through this service nor comprehensively monitor users' usage behavior. Therefore, it cannot guarantee the legality, accuracy, completeness, authenticity, or quality of the content. Users acknowledge that when using this service, they may encounter content that is unpleasant or inappropriate, and agree to independently assess such content and assume all risks, without relying on the AI+ service; If SwitchBot discovers through notifications, reports, or other means that a user's use of AI+ Services violates applicable laws or regulations of SwitchBot or the user's country or region, SwitchBot reserves the right to make an independent judgment and may immediately terminate the provision of all or part of the service to the user without prior notice, as well as require the user to rectify the situation or directly take all measures deemed necessary by SwitchBot (including but not limited to modifying or deleting user-uploaded content, suspending or terminating the user's right to use the AI+ service) to mitigate the impact of the user's improper conduct. If a user uses the AI+ service to disseminate or spread reactionary, pornographic, or other information that violates the laws or regulations of other countries or regions, the system records of the AI+ service may be used as evidence of the user's violation of laws or regulations. Any claims, damages, or losses arising from the user's uploading or dissemination of such content through the AI+ service shall be the sole responsibility of the user.
4. Intellectual Property Protection
If users upload content that allows other users to download, view, listen to, or otherwise access or distribute such content, they must ensure that the publication and related actions comply with the relevant copyright policies under applicable intellectual property laws and regulations, including but not limited to:
4.1 Upon receiving a notice of infringement, users must immediately remove or block access to the alleged infringing content and simultaneously contact the person who delivered the notice to obtain further details;
4.2 Users acknowledge and agree that SwitchBot will process valid infringement notices issued by third parties in accordance with relevant laws and regulations, remove or block access to the alleged infringing content as required, and adopt and implement appropriate policies to prevent repeated infringements under similar circumstances.
5.Privacy Protection
5.1 SwitchBot respects user privacy. The Privacy Policy and AI+ Video Collection Privacy Policy outline how data is collected and used.
5.2 SwitchBot will not disclose or provide users’ non-public content to third parties, unless:
Required by law;
In emergencies to protect user/public safety; To protect SwitchBot's trademark rights, patent rights, and other legitimate rights and interests; Other situations where personal information needs to be disclosed, edited, or revealed in accordance with the law
6. Disclaimer
6.1 Given the nature of AI+ services as network services and the special characteristics of network services, users agree and understand that in the event of network failures caused by reasons beyond SwitchBot's control, some or all services may be changed, interrupted, or terminated. Once SwitchBot discovers and verifies a network failure, it will notify users in advance as much as possible, but SwitchBot shall not be liable to any user or any third party for any reason.
6.2 Users understand that AI+ services may require regular or irregular maintenance or repairs of the platform or related equipment providing network services. If such circumstances result in a reasonable interruption of services, SwitchBot shall not be liable for any such interruption, but shall endeavor to provide prior notice whenever possible.
6.3 Any disputes or losses arising from users authorizing third parties (including third-party applications) to access or use the content of their AI+ service space shall be the sole responsibility of the user and shall not involve SwitchBot.
6.4 The following matters (but not limited to these) shall not be attributed to SwitchBot's responsibility, and SwitchBot shall not be liable for any damages incurred by users as a result.
(1) Implementation of scheduled maintenance;
(2) Natural disasters such as earthquakes, typhoons, floods, or storms; outbreaks of infectious diseases; wars, civil unrest, or riots;
(3) Orders from administrative or judicial authorities;
(4) Malfunctions of the user's own devices; (5) Defects in the client environment;
(6) Malfunctions caused by the user's settings of the service environment or computers;
(7) Network line failures when connecting to cloud services;
(8) Improper operations by the user;
(9) Third-party attacks and cheating.
6.5
We do not guarantee the accuracy, reliability, or applicability of AI recognition, analysis, and decision-making functions. AI models may be affected by environmental factors (such as lighting conditions, camera angles, or obstructions), technical limitations, or data biases, which may impact recognition performance. Users understand and agree that AI recognition results may include false positives or false negatives. Users should make their own judgments based on other information and assume the risks associated with relying on AI recognition results.
7.Miscellaneous
7.1 Final interpretation rights belong to SwitchBot.
7.2This Agreement shall take effect upon publication. SwitchBot reserves the right to modify the terms of this Agreement at any time, with the modified version published on the SwitchBot website or App. If you do not agree with the modifications to the terms of this Agreement, you have the right to cease using the AI+ service. If you continue to use the AI+ service, it shall be deemed that you accept the modifications made by SwitchBot to the relevant terms of this Agreement.
7.3 Under this Agreement, all notices from AI+ Services to users may be made by means including but not limited to announcements and emails; such notices shall be deemed delivered on the date of sending.
7.4 The establishment, execution, interpretation, and resolution of disputes under this Agreement shall be governed by Japanese law. If any disputes arise regarding the content or execution of this Agreement, the parties shall endeavor to resolve such disputes through friendly negotiations. If such negotiations fail, either party may bring a lawsuit before the Japanese court with jurisdiction over the location of SwitchBot Co., Ltd.
7.5 This Agreement constitutes the entire agreement between the parties regarding the matters set forth herein and other related matters. Except as provided herein, no other rights are granted to the parties under this Agreement.
7.6 If any provision is invalid or unenforceable, the remainder remains effective.
